I Need Help

If you believe you may be facing discipline:

  • Do not discuss anything with a supervisor, management or your co-workers;
  • During normal business hours, contact the POA's Legal Defense Fund provider, Bobbitt, Pinckard, & Fields at (858) 467-1199;
  • If you are involved in an after hours Critical Incident (officer involved shooting, use of force that results in great bodily injury, in custody death, on duty traffic accident that results in GBI or death), or are unable to contact someone at (858) 467-1199 during normal business hours, call PORAC's 24 hour emergency hotline at 1-888-556-5631.

The Supreme Court has ruled that an employee is entitled to have a Union Representative present during any meeting which may result in discipline. These are called your Weingarten Rights.

  • You must request that a Union Representative be called into the meeting.
  • You must have reasonable belief that discipline will result from the meeting.
  • You must have the right to know the subject of the meeting and the right to consult your Union Representative before the meeting to get advice.
  • Do not refuse to attend a meeting if they deny your request for a Union Representative to be present. We suggest you attend the meeting and repeatedly insist upon your right to have a union Representative present. If this fails, we suggest that you do not answer any questions and take notes.
